My fingerprints are not on it because I would have walked away without touching the place once I saw the condition in question.
But, now we know its a hazard. Who has the liability these days if the contractor didn't say anything even though he didn't touch it?
You get in trouble for being a good Samaritan and get in trouble for not being a good Samaritan.
i'd document what i did, and what i observed that i did not touch.
then i'd go to the AHJ, and speak to them. explain what i did, and
what i saw.
explain that i don't really want to be the one to go in and fix it, but at
the same time, i don't want to be the one to own it if it fails.
then i'd file a formal complaint of a public hazard, sign it, get a copy,
and walk away.
unlike third party internet stories, i've been in a situation where if i'd a gone
to the AHJ over a job i refused to work on, an 18 year old college student
would most likely still be alive.
and i ended up getting sued for $2.5M for a job i did not work on.
just a thought. i'd go down monday, and file a report.
and i'd make sure that if was contacted about the job, i'd let it go to someone
else.
