But I do wonder if this is a case where the AHJ has the authority to approve of the install anyway? (I forgot the Code article and I'm too lazy today to go get my Code book.) :)

Oh, and I'm still not seeing any proof that the 3-way is being used in violation of its listing...like someone else pointed out, I don't see this differing from the dishwasher/disposall selector usage.

Using the 2005 all 702.4 requires is that 'all equipment shall be approved for the intended use' that is not the same as listing.

But 702.6 requires that transfer equipment be suitable for the intended use.

Not having clear markings about which source is connected would be one issue I think an AHJ could have.

Then of course there is the info that Jim provided about common three ways not being tested for two circuit use.

There is a UL listing for transfer switches, it is not the same as a standard switch.'

Another common example is a simple 15 amp two pole switch switch you might use to control a 240 volt fixture.

If I use it to control two different circuits as odd as it sounds it is a violation of the listing unless it is marked for two circuit use.
 
what do you mean "leaves the cord plugged in" ??

We are only dealing with one cord, if it stays connected to the gen. and the new 'inlet'

during normal use ( while on utility ) , then the n/grd bond at the gen. outlet will put the

utility neutral to any metal parts that the EGC is connected to. Unplug the cord and it will

go away, but electricly it is not fail safe that it doesn't happen.
 
Some where in this thread,.. I pasted a little transfer panel ,.in fact, Reliance makes a furnace single circuit switch for this very purpose ,.. the neutral connection is the same .. that is you connect the T.S. via an inlet run a cord to the gen,.. the transfer switch does not break the neutral , so if this cord is left plugged in ,. it is the same ,..???
