Min size conductor and 250.122(B)

210.19(A)(1) says to pick larger of the two but in my case they are the same???
So now go to 240.4...

Is the #8 protected by a 50A c/b (as required by 625.41) in accordance with it's ampacity specified in 310.15 (an ampacity of 40)?

The answer is no. A conductor with an ampacity of 40 cannot be protected by a 50A c/b, so you need a larger conductor.

But the way I see it you go to 210.20 which says to comply with 210.20(A) through 210.20(D) which then refers to 240.4. From that I do see where you are coming from
