I'm going off of 310.15 (B)(6)I don't believe either of those would be allowed for a sub-panel.

I didnt know that Mass was on 2008 code maybe you know better. We will see...No on two counts: If he used CU SER, then he would have had to use #1 CU SER, under the 2008 NEC.
If the feeder were between the service and a panelboard that served the entire dwelling unit, he would be able to use the table. It doesn't apply only to service conductors.
