Awww, come on. If we put our heads together we can find SOME code violation. Hey! The conduit coming through the back, it cut out part of the required labelling. That must be what you saw and just forgot.

Someone destroyed the labeling in the back of the enclosure that would have pertinent information by installing the conduit through that location. Did they replace the label/markings to a different location?
This could result in a 110.3(B) violation, Also depending on label that have been dammage could be 110.9, 110.10.
Also again depending on exact labels damaged could result in a 110.14(D) and proper torque specified by mfg might be unknown.
Also could have a 110.7, 110.12, issue looking at the chaffing on the wires.

Pop that CH cover and see if there is a hold down device on the back fed 40. If In deed it's a main the tap lands on.

I see a lot of green wire. Is that a feeder tap.
