Re: Unbelievable

Family rates freebies, and I also have friends who rate them, but it's a short list. They don't abuse it, and they have also done me plenty of solid favors over the years, so they are on the freebie list for good reason.

In this case, the deadbeat is the sister of someone on the freebie list. She apparently thought that since her brother is a good friend of mine, she deserved a preferred rate (she even insisted on getting the "family discount"). She should be getting the court summons any day now. I'm guessing the summons might cause her to realize she's not on my freebies list. :D

Re: Unbelievable

she knew it was'nt for free, she asked how much it was going to be before the work started, thats when he got out the defibrillator,,
this is his friends "sister",,not his friend.
we all do favors for family and friends,of course we do.up to a certain extent,
i hang ceiling fans & stuff for nothing, but i cant do additions & pools or basements for nothing,,who can?

Re: Unbelievable

Yeah, the few people who are on my freebies list also act like they aren't on my freebies list. Anytime they ask for a favor, they are pretty quick to offer things to me in return. This often involves feeding me tasty food. I have yet to refuse this kind of treatment. :D

I've got some updates on my continuing quest to get paid. Today I received my summons for the court hearing, so I assume the defendant has received hers or will very soon. I've got a court date in January.

The other day my lawyer called me with an idea as to how to make the deadbeat pay up before it winds up in court. She suggested that I contact the homeowner, who the deadbeat has known since childhood. My lawyer said that the thing that would really motivate the deadbeat is to bring shame upon her within her peer group. So I talked to the homeowner yesterday, and he told me he was pretty upset that she would blow me off like this. He reiterated that he was quite pleased with the job I did for him and said he would contact her immediately to demand that she pay me right away. He also said that he wants me to come out and do more work on his place, and he certainly doesn't want this incident to keep me from doing that.

Today my lawyer called me again and said that word has spread to the deadbeat's mom, who is embarrassed now, and apparently the deadbeat is now scrambling to find enough money to pay me.

Perhaps I'll get paid finally. Then again, I'll believe it when I see a check in my mailbox.

Cash, Money Order, or Certified Check including the costs you have already put forth towards the court. Legally you are entitled those fees.

Re: Unbelievable

The check arrived in my mailbox yesterday. Naturally, it wasn't for what I was entitled to. She managed to not pay the permit fee ($60) or the $55 I had to pay to file the lawsuit. So I got $700. Yeah, technically I could still take her to court for the remaining $115, but it's not worth the trouble at this point.

Once the check clears, I'll drop the lawsuit, and that will be the end of my dealings with her. I'm not sure what finally got her moving with the money, but I'm not going to put myself in the position again of having her owe me any money.

If anyone reading this is working in the Minneapolis area, feel free to PM me if you want details so you will know to avoid doing work for her.

Re: Unbelievable

BULLONEY! She still owes you another $115. You can still get the judgement on that amount! It is worth it! If you think it's not send me the money!
Hold your to your guns.

edited correct amount

Re: Unbelievable

I support your decision to call it a day. Considering only the time you would have to invest to pursue your legal rights, it would cost you more than you would gain.

Re: Unbelievable

Sure, I could still get the judgement for the $115, but I'd have to spend time going to court, and even if I were to win, I'd have to invest even more time trying to actually get paid. The court was very clear about how it only issues judgements and is not a collections agency. I'd have to mess around with locating her assets, trying to get her wages or tax returns garnished, etc. I would not be compensated for all that time.

Charlie's right -- it would cost me more than it would be worth to continue pursuing the matter.

Re: Unbelievable

9 yrs ago we filed a small claims on a lady for $125. ABout a year ago she came in and wanted to pay because their was a lien on her house, which she wanted to refinance.
I got my $125, plus court costs, plus interest.
My receptionist just returned from small claims this morning. She was there for 15 minutes.
You decide.
I have made the decision to forget some of the debts because of the hassle of trying to get paid. But in the end the decision is yours.
You may want to send her/call her and remind her she owes you another $115. If she balks, say "See you in court." Sometimes a bluff will get you paid!

Re: Unbelievable

In this case, I can't file a lien on the house. I didn't follow the necessary procedures to secure my rights to file a lien, and the deadline has passed for me to do so.

Since I'm a one-man show, I'd be the one who has to spend time going to court, and I'm the one who would have to spend time tracking down her assets, trying to get her wages garnished, etc. I made more than $115 on a service call last night that took me far less time than the legal procedures would.

In the end, the $115 isn't going to bankrupt me. I will be more careful in the future about securing my lien rights, though.

Re: Unbelievable

This one's for you, Larry:

Today I received a letter from the "Judge Mathis" TV show. Apparently someone from the show got wind of my lawsuit, and they have invited me to contact them because they are hoping to help me get the money I feel I deserve.

I wonder if they sent a similar letter to the defendant saying they are hoping to protect her assets.

Re: Unbelievable

They must look for small claim cases all the time.I had a friend that was on Judge Judy. They told him they would pay for the judgement if he lost. And would also pay for airfare and expenses for him and a companion.Go and have a fun, free , weekend.Where is the show filmed out of?

Re: Unbelievable

I suspect the defendant wouldn't be all that interested in getting her face on TV, particularly since she really has no case. I doubt that kind of publicity would help her business. Also, they say the camera adds 10 pounds, and, um ... well, let's just say she probably doesn't want to be seen on TV.

Besides, I've gotten most of the money from her already. We're talking about $115 at this point.

The letter they sent was from Chicago, so I'm guessing they film the show there.

Re: Unbelievable

If you go there is a chance she will make money out of this. They do get paid.Dont help her ,just continue with the court date and destroy her credit.Willing to bet she will be a no show and you win by default.Let her think your still going after her and she might just pay in full.
