How so?

If we are talking national than maybe as the NM looks closer than 1.25" to the framing members it is parallel to.

If we talk MA than I do not see a violation as in MA the NM only has to be 3/4" from the strapping.

Take a good look at MA 334.17 about 1/2 way down the second paragraph.

As Bob has already mentioned, the furring strips in op are used to support drywall. Most builders and carpenters refer to it also as "strapping".

Thanks everyone for some good replies. For the two who asked I am the inspector in the towns of Millville and Uxbridge and the assistant in Blackstone. j_Erickson I called the Milford office yesterday hoping to get an opinion from Mike but I missed him.

I contacted the person that did the work yesterday and told him that I consider the work a violation of NEC and MEC and to secure the romex as per 334.30. I also told him that I respect his right to appeal my decision and that I would not be offended if he did so.Thanks again romeo

Yeah, Scott, what are you seeing that I'm not? From the picture, some nm's may be too close, but it's hard to say.

.30 is securing and supporting.
Romeo, I believe you are correct, as the cables in your scenario are properly supported, but not properly secured.

Bob's picture show the installation with the cables secured to the floor/ceiling joists. I see that as a compliant installation. 300.4(D) is for cables installed parallel to the framing member/furrinng strips.
