Just as I am sure that you cannot speak for all inspectors. As to your opinion of the inspectors in your area, I am also left with doubts... :happyyes:

It has a listing tag that says wireway.

110.3(B) requires we respect the listing and labeling.

Can you cite a code section that allows 110.3(B) to be ignored by the AHJ?

UL MARK The Listing Mark of Underwriters Laboratories Inc. on the product is the only method provided by UL to identify products manufactured under its Listing and Follow-Up Service. The Listing Mark for these products includes the UL symbol (as illustrated in the Introduction of this Directory) together with the word ?LISTED,? a control number, and one of the following product names as appropriate: ``Wireway or Auxiliary Gutter,'' ``Wireway,'' ``Auxiliary Gutter,'' ``Wireway or Auxiliary Gutter Fittings,'' ``Wireway Fittings'' or ``Auxiliary Gutter Fittings.''

It seems to me UL considers wireways and auxiliary gutters to be similar but not the same unless marked "Wireway or Auxiliary Gutter"

Auxiliary gutters and metal wireways are not required to be listed.

110.3(B) states, "Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling." It does not say it must be used only in accordance with its listing category. The category title itself is not an instruction.

Regarding the UL whitebook reference to product name, just exactly what is the criteria for "as appropriate"?

Every class I have been to that talked about auxiliary gutters said that they were part of and supplied by the manufacturer of the panel that they are auxiliary to.

The Square D catalog says their duct (NEMA 1, NEMA 3R, and NEMA 12 types) is "UL listed as steel enclosed wireway and auxiliary gutter" in the general description area of each.

Class instructors do not always teach all the facts and only the facts. They too can be opinionated, or believe only as they have learned or been taught... or not. Omission of fact, knowingly or unknowingly, can make partial fact seem complete.

Yet if you look at the referenced document, there is no mention of being listed as auxiliary gutter.
